Acceptance of these terms

This website is operated by TURTLE Watch Co. (“TURTLE,” “we,” “us,” or “our”). By accessing the website, joining a waitlist, contacting us, or purchasing a product, you agree to these Terms of Service and the policies linked from this page. If you do not agree, do not use the website or services.

You must be at least the age of majority where you live, or use the site with the permission and supervision of a parent or legal guardian.

Product information and imagery

We work to present product descriptions, specifications, dimensions, colors, prices, and availability accurately. Screen settings, lighting, manufacturing tolerances, and natural material variation may affect appearance. Pre-production renderings or concept images will be identified as such and are not a guarantee that every production detail will be identical.

Before an ordering window opens, TURTLE will publish the final product information reasonably available at that time. We may correct errors or update information without prior notice.

Orders, payment, and acceptance

Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not necessarily mean the order has been accepted. We may decline or cancel an order for suspected fraud, payment failure, inventory error, pricing error, shipping restriction, purchase-limit violation, or another legitimate business reason. If payment has been captured for a cancelled order, it will be refunded.

Prices are shown in the currency indicated at checkout. Taxes, shipping, duties, and other charges may be added where applicable. Payment is processed by third-party payment providers under their own terms and privacy practices.

Preorders and limited releases

Limited quantities may sell out. Joining a waitlist does not reserve a product or create an obligation to purchase. For preorders, production and delivery dates are good-faith estimates and can change because of manufacturing, quality control, transportation, customs, or events outside reasonable control.

If a material delay occurs, TURTLE will provide an update and any cancellation or refund rights required by the terms shown at checkout and applicable law.

Shipping, returns, and warranty

The Shipping & Delivery Policy, Returns & Refunds Policy, and Warranty & Repairs Policy are incorporated into these Terms. Product-specific terms shown before checkout also apply. Where a conflict exists, the more specific product or checkout term controls unless prohibited by law.

Permitted use

You may use this website only for lawful personal or commercial interactions with TURTLE. You may not interfere with site security or operation, introduce malicious code, scrape or harvest data at scale, impersonate another person, submit false information, misuse forms, attempt unauthorized access, or use the website or products for an unlawful purpose.

Intellectual property

The TURTLE name, logos, product names, designs, photographs, graphics, copy, and website presentation are owned by or licensed to TURTLE and are protected by intellectual-property laws. You may view and use the site for personal, non-commercial purposes. No other license is granted. Commercial reproduction, modification, distribution, or use requires prior written permission.

Third-party services and links

The site may use or link to third-party services such as hosting, forms, social media, payment, analytics, or shipping providers. TURTLE does not control their services, availability, content, or policies. Your use of a third-party service is subject to that provider’s terms.

Disclaimers

Except for express warranties stated in writing and rights that cannot legally be excluded, the website and services are provided on an “as available” basis. We do not warrant uninterrupted operation, error-free content, or that all site information will remain current at all times.

Watch water-resistance ratings are laboratory ratings and require proper use and maintenance. Product information is not professional diving, medical, safety, or technical advice.

Limitation of liability

To the maximum extent permitted by law, TURTLE will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or opportunity, arising from the website, products, or services. To the extent liability cannot be excluded, TURTLE’s aggregate liability for a claim relating to a purchased product will not exceed the amount paid for that product, except where a greater remedy is required by law.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to any non-waivable consumer rights, disputes that cannot be resolved informally will be brought in a court of competent jurisdiction located in Orange County, California.

Before filing a claim, please contact TURTLE and provide a reasonable opportunity to resolve the issue directly.

Changes and severability

We may update these Terms by posting a revised version with a new date. Changes apply prospectively unless law requires otherwise. If any provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver.
